ARTICLE 1. PERSONAL DATA AND PRIVACY

Here we describe how we collect, use and handle your information when you use our websites, software and services (“Services”).

What & Why

We collect and use the following information to provide, improve and protect our Services:

User Accounts. We collect, and associate with your account, information like your name, email address, phone number, payment info, and physical address. Some of our services let you access your accounts and your information with other service providers.

Usage. We collect information from and about the devices you use to access the Services. This includes things like IP addresses, the type of browser and device you use, the web page you visited before coming to our sites, and identifiers associated with your devices. Your devices (depending on their settings) may also transmit location information to the Services.

Social Networks. We collect Data about the use of social networks when you use the features.

Cookies and other technologies. We use technologies like cookies and metadat to provide, improve, protect and promote our Services. For example, cookies help us with things like remembering your username for your next visit, understanding how you are interacting with our Services, and improving them based on that information. You can set your browser to not accept cookies, but this may limit your ability to use the Services.

IP Addresss. Regarding the IP address data, SplashSync reserves the right to use the Internet user's IP address, in cooperation with its internet access provider, in order to identify the Internet user if it deems it necessary to enforce its Terms of Use. or to protect its services, its customers or at the request of the judicial authorities.

What we don't

We will never collect and use the following information you shared with our Services:

Private Data. When you use our Services, we store, process and transmit your data (including stuff like pictures, files, structured data and emails) and information related to them (for example, last edition date of an object) within your connected client servers. But none of data will be used for improveent or commerial sharing of any kind. Only meta data (such as objects counters, data size) are used for monitoring and improving our Services. 

With whom

We may share information as discussed below, but we won't sell it to advertisers or other third-parties.

Others working for Splash Sync. Splash Sync uses certain trusted third parties (for example, providers of customer support and IT services) to help us provide, improve, protect, and promote our Services. These third parties will access your information only to perform tasks on our behalf in compliance with this Privacy Policy, and we'll remain responsible for their handling of your information per our instructions.

Other users. Our Services display information like your name and email address to other users in places like your user profile and sharing notifications. Certain features let you make additional information available to other users.

Other applications. You will also give third parties access to your information and account when connecting and synchronizing client servers. Just remember that their use of your information will be governed by their privacy policies and terms.

Law & Order. We may disclose your information to third parties if we determine that such disclosure is reasonably necessary to : (a) comply with the law; (b) protect any person from death or serious bodily injury; (c) prevent fraud or abuse of Splash Sync or our users; (d) protect Splash Sync's property rights.

Stewardship of your data is critical to us and a responsibility that we embrace. We believe that our users' data should receive the same legal protections regardless of whether it's stored on our services or on their server and home computer's hard drive. We'll abide by Terms of Service when receiving, scrutinizing and responding to government requests (including national security requests) for our users' data:

  • Be transparent,
  • Fight blanket requests,
  • Protect all users, and
  • Provide trusted services.

How

Security. We have a team dedicated to keeping your information secure and testing for vulnerabilities. We also continue to work on features to keep your information safe in addition to things like two-factor authentication, encryption of files at rest, and alerts when new devices and apps are linked to your account.

Retention. We'll retain information you store on our Services for as long as we need it to provide you the Services. If you delete your account, we'll also delete this information. But please note: (1) there might be some latency in deleting this information from our servers and back-up storage; and (2) we may retain this information if necessary to comply with our legal obligations, resolve disputes, or enforce our agreements. You can access your personal information by logging into your account.

Where

France. Our Services currently only store data in France. To provide you with the Services, we may store, process and transmit information in the United States and locations around the world - including those outside your country. Information may also be stored locally on the devices you use to access the Services.

Changes

If we are involved in a reorganization, merger, acquisition or sale of our assets, your information may be transferred as part of that deal. We will notify you (for example, via a message to the email address associated with your account) of any such deal and outline your choices in that event.

We may revise this Privacy Policy from time to time, and will post the most current version on our website. If a revision meaningfully reduces your rights, we will notify you.

Right of access and rectification

The User can choose how the Data is transmitted and used on the Site.

The Internet user can browse the Site without providing Data. If necessary, he may not use certain features of the Site, nor access information reserved for Registered Users.

The User can access his account at any time to view or modify the User Data

In accordance with the provisions of the regulations applicable to the protection of personal data, in particular the European Data Protection Regulation 2016/679 (the "GDPR") as well as in article 34 of the law "Informatique et Libertés" (Law Nº78-17), the Internet user may at any time access personal information concerning him or may request their rectification, their addition, clarification, updating or deletion by simple letter addressed to the head office of Splash Sync ®, by email (contact form), giving his name, first name, date and place of birth, postal address and e-mail.

In addition, subject to the conditions provided by the aforementioned regulations for the exercise of these rights, the User benefits from:

  • Right to erase data ;
  • From a right to the limitation of data processing ;
  • Right to oppose the processing of its Data for legitimate reasons, in accordance with Article 21 of the GDPR ;
  • A right to portability on the Data provided (for automated processing based on consent or performance of a contract) ;
  • The right to withdrawal of consent, where requested.

When the processing of the Data is done on the basis of the User's consent, he may withdraw the consent at any time. The User acknowledges, however, that the processing carried out before the revocation of this consent remains perfectly valid.

Splash Sync has a period of one month to respond to any request relating to the exercise of the rights of the User. This period may be extended by two months because of the complexity or the large number of requests.

Shelf life of personal data

The collected Data are kept for the duration to respect the purpose of their collection.

The shelf life varies according to the Data in question, the nature and purpose of the collection being likely to vary this duration. Similarly, some legal requirements impose a specific retention period.

The User's email address, which is also his login ID, is kept until unsubscribed.

The remainder of the Data will be retained for five (5) years from the User's request to deactivate his account.

When requesting a deletion of the User account, the Data is deactivated and then completely deleted at the end of the aforementioned periods from the day of the request.

Finally, with regard to data collected by means of cookies or tracers, they will be kept for up to six (6) months for cookies or tracers measuring the audience and up to thirteen (13) months for others. Beyond the above mentioned retention periods, the collected Data will be anonymised to be kept for exclusively statistical purposes.

ARTICLE 2. COOKIES

Cookie definition

A cookie is a small text file that is placed or stored on your device (computer, tablet or mobile device) when you visit a website. The cookie allows a site to recognize you, to help you navigate from page to page on a website, provides secure connections and remembers your preferences during your next visits.

Their shelf life varies depending on the type of cookie used. Session cookies only last for a browsing session, that is to say, the arrival of the user on the site until the closing of his Internet browser. Splash Sync ® require acceptance of its cookies policy to Users at the bottom of each platform page at the beginning of each session.

You can click "OK" to accept cookies or edit cookie settings in your browser.

In the event that the User has not given his consent, Splash Sync ® does not record any cookie and uses only the technical cookies necessary to navigate the Site.

The User may limit, block or delete cookies from Splash Sync ® or any other web page.

Deleting cookies

The User may at any time disable the cookies stored on his terminal. To do this, simply select the appropriate settings in his browser. However, this deactivation will prevent access to certain features of the Site to customize the services offered.

The different types of cookies used

Strictly necessary cookies: These cookies allow you to browse the Site and are essential for the proper functioning of the Site. Disabling them will cause difficulties in the use of the Site and will prevent access to certain features.

Functional cookies: these cookies allow you to remember your preferences, your choices in order to personalize your experience on the Site.

Performance cookies and statistics: these cookies collect information on how users use the Site (the number of visits, the number of pages viewed, the activity of visitors) via the Google Analytics analysis tool. They also help us to count the activity of our advertising space, to measure the audience, etc ...). Splash Sync ® does not manage the data collected by social networks via the buttons. ARTICLE 3. HYPERTEXT LINKS ESTABLISHED FROM THE SITE

Hypertext links to Third Sites

The Site may contain hypertext links to other websites that are not owned by Splash Sync ® or are not controlled by Splash Sync ® (hereinafter "Third Party Sites").

Users may not reproduce the hypertext links on the Site and in particular those relating to Private or Confidential Information.

Splash Sync ® has no control over the content, the personal data protection policies or the practices of the Third Party Sites and declines all responsibility in this respect.

Splash Sync ® is not responsible for the availability of Third Party Sites and external resources and does not endorse the advertising, products or other materials on these websites.

Hypertext links to the Site

Any hypertext link to the Site and using the following techniques is prohibited without prior authorization:

  • The "framing" defined as a technique allowing, without leaving the site of origin, to insert a page of the Site which is displayed in a frame of the web page of origin;
  • The "deep-linking" defines as the insertion of a hypertext link referring to a secondary page of the Site;
  • The "inline linking" defined as a hyperlink to include in the original web page an image from another web page is prohibited.
